"Hilton HHonors® and National Car Rental® Five Million Reasons To Book Online Sweepstakes" (“Sweepstakes”) Official Rules (“Official Rules”)
No purchase or contribution or hotel reservation or stay or automobile rental required to enter or win the Sweepstakes.
Eligibility: This Sweepstakes is open only to persons who are, as of September 1, 2008, age eighteen (18) or older, and legal residents of the United States (excluding its territories, military installations, commonwealths, and Puerto Rico) and the District of Columbia. Employees of Hilton Hotels Corporation (“Hilton”), National Rental (US) Inc. (“National”) (collectively, “Sponsors”), and their respective parents, subsidiaries and affiliates, advertising and promotion agencies, licensees, those involved in the development, production, administration, implementation, and distribution of this Sweepstakes, and/or any other persons or entities associated with this Sweepstakes, including, but not limited to persons affiliated with a Sweepstakes Sponsor, and their immediate families (spouse, children, siblings, parents and their respective spouses) and those living in their households (whether related or not) are not eligible to participate, win or use any prize. Void in U.S. territories, military installations, commonwealths, Puerto Rico and where prohibited.
How to Enter: The Sweepstakes begins at 12:01 a.m. Central Daylight Time on September 1, 2008, and ends at 11:59 p.m. Central Standard Time on November 30, 2008 (the “Sweepstakes Period”). During the Sweepstakes Period, go to 5millionreasons.com and fill out the online registration form completely and submit the form to be registered for the Sweepstakes. Your completed registration earns one (1) Sweepstakes entry.
Once you have registered for the Sweepstakes, you may earn additional entries by any of the following three methods:
1. Make an online reservation at hiltonhhonors.com, hiltonfamily.com, conradhotels.com, doubletree.com, embassysuites.com, hamptoninn.com, hilton.com, hiltongardeninn.com, hiltongrandvacations.com, hiltonworldwide.com, homewoodsuites.com, or waldorfastoriacollection.com for any Hilton Family hotel stay worldwide during the Sweepstakes Period. Hotel reservation must include the same Hilton HHonors account number or email address provided with your Sweepstakes registration and your stay must be completed by December 15, 2008. Canceled reservations or bookings that are not fully consumed by December 15, 2008 are ineligible. You will receive one (1) entry upon check-out, provided the check-out occurs by December 15, 2008. Reservations that are made by phone, in-person, or through any other method other than those set forth above will not be eligible to receive an entry.
2. Rent a Qualified Rental during the Sweepstakes Period. To earn an entry, you must make an online reservation at nationalcar.com using the same e-mail address provided with your registration. Subject to the eligibility and certain conditions contained in these Official Rules, a “Qualified Rental” is the rental of one (1) midsize or larger vehicle for one (1) or more rental days at a National Rental facility located in the fifty (50) United States or the District of Columbia during the Sweepstakes Period and completed without breach of the rental agreement. You may rent from the same or different facility more than once during the Sweepstakes Period, but consecutive rental days will be treated as a single Qualified Rental, regardless of multiple check-ins or check-outs. Multiple rentals on the same reservation that are credited to the same registered entrant’s account qualify as separate Qualified Rentals [For example, by reserving and renting two (2) cars for one (1) day each from a participating National facility located in the fifty (50) United States or the District of Columbia during the Sweepstakes Period, the person to whose account the cars were credited may earn two (2) entries in the Sweepstakes.] You are limited to a maximum of two (2) Qualified Rentals per day (defined as the date of vehicle return, which is further subject to a maximum number of two (2) entries per day, whether earned by registration, vehicle rental, and/or hotel stay and each Qualified Rental earns one (1) entry. A Qualified Rental must be booked during the Sweepstakes Period and must be completed by December 15, 2008. Rental cars reserved, but not actually rented and returned by December 15, 2008 will not earn an entry. Entries are submitted upon return of the Qualified Rental, provided the return occurs by December 15, 2008. Reservations that are made by phone, in-person, or through any other method other than those set forth above will not be eligible to receive an entry.
3. Each time you complete and submit a registration for the Sweepstakes, you are automatically entered in the Sweepstakes (limit 2 entries per day).
LIMIT TWO (2) ENTRIES PER PERSON PER E-MAIL ADDRESS PER DAY, REGARDLESS OF METHOD OF ENTRY. The first two entries per person will be accepted. Any subsequent entries on the same day will be disqualified. In the event of a dispute as to any registration or play, the authorized account holder of the email address used to register will be deemed to be the registrant or player. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder, in addition to otherwise meeting the necessary eligibility criteria.
Use of data: Sponsors will be collecting personal data about entrants online and in connection with their hotel stays and/or vehicle rentals, in accordance with their respective privacy policies. Please review these privacy policies at hilton.com and nationalcar.com. By participating in the Sweepstakes, entrants hereby agree to Sponsors’ collection and use of their personal information and acknowledge that they have read and accepted Sponsors’ privacy policies. Further, Sponsors will be required to supply to the Sweepstakes administrator, 1-2-1 Marketing Services Group (20195 South Diamond Lake Road, Suite 700, Rogers, MN 55301), certain entrant personal information regarding car rental activity or hotel stay activity solely for administering the Sweepstakes and so that the winners may be drawn. The winners’ identities will be disclosed as specified below within the Official Rules and Winner’s List portion of these Official Rules.
By registering, you fully and unconditionally accept and agree to be bound by these Official Rules and the decisions of the Sponsors, which are final and binding in all matters. You also agree, to the extent allowed by law, to waive any right to claim ambiguity or error in these Official Rules or in the Sweepstakes itself. Any attempted form of entry other than as described herein is void. Registrations or entries generated by script, macro or other automated means are void. Sponsors reserve the right to request proof that potential winner is the authorized account holder of the e-mail address associated with the potentially winning entry. In the event of a dispute as to who submitted an online reservation, the prize will be awarded to the name on the reservation. Released Parties (as defined below) are not responsible for incorrect or inaccurate transcription of entry information, for problems related to any of the equipment or programming associated with or utilized in the Sweepstakes, for any technical or human error which may occur in the processing of the entries in this Sweepstakes, for any human error, for any booking and/or errors in check-out, for any interruption, deletion, omission, defect, or line failure of any telephone network or electronic transmission, for problems relating to computer equipment, software, inability to access any Web site or online service, for any other technical or non-technical error or malfunction, for lost, late, stolen, incomplete, garbled, misdirected or entries not received by the deadline for whatever reason. Incomplete entries will be disqualified.
Conduct: If for any reason the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical corruptions, legal invalidity, or failures, or any other causes beyond the reasonable control of the Sponsors which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Sponsors reserve the right, at their sole discretion, to disqualify any individual (and all of his or her Sweepstakes entries) who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes and void such entries. Should the Sweepstakes be suspended or terminated prior to the stated termination date, notice will be posted on 5millionreasons.com for a period of thirty (30) days. In the event this Sweepstakes is terminated early, the prizes will be awarded in a random drawing from among all eligible, non-suspect entries received by the termination date.
Drawing: The potential winners will be selected by random drawing on or about January 9, 2009, from among all eligible entries received by 1-2-1 Marketing Services Group, an independent judging organization, whose decisions are final and binding in all respects relative to this Sweepstakes. The potential winners will be notified by phone, overnight mail, and/or e-mail within approximately two (2) weeks of the drawing date. If any potential winner cannot be reached after a reasonable effort via phone, email and/or overnight mail, if he/she is found to be ineligible, or if he/she cannot or does not comply with these Official Rules, he/she will be disqualified and an alternate potential winner may be selected from the remaining eligible entries. Alternates will be drawn until all five winners have been established and eligibility verified. Odds of winning depend on number of eligible entries received.
Prizes: There are five (5) Grand Prizes as follows:
Each Grand Prize is 1,000,000 Hilton HHonors bonus points. Approximate Retail Value (ARV) of each Grand Prize is $10,000.00 U.S. Dollars. Approximate total ARV of all prizes is $50,000.00 U.S. Dollars. Should any winner not be a member of Hilton HHonors, a membership number will be issued.
Hilton HHonors membership, earning of Points & Miles®, and redemption of points are subject to HHonors Terms and Conditions.
Each winner will be responsible for all income taxes on the value assigned to the prize. Winners will receive a 1099 Miscellaneous Tax Form for this amount. All federal, state and local government surcharges, and all taxes (sales, income, airport, value-added and other), gratuities, incidental expenses, licenses, registrations, port charges, telephone calls, travel insurance premiums, and all other costs and expenses relating to acceptance or use of these prizes are the sole responsibility of each winner. Winners should consult with a tax advisor for details on how to report this winning on a tax return.
Certain Conditions: All potential winners will be required to sign an affidavit of eligibility and a liability release and, where lawful, a publicity release (collectively “Affidavit/Release”), all of which must be signed, notarized and returned within fourteen (14) days of date of issuance or prize will be forfeited and an alternate winner may be randomly selected from the remaining eligible entries. Alternates may be drawn on an “as required” basis when/if a potential winner is found to be ineligible. If a potential winner is a minor in his/her state of residence, the minor’s parent or legal guardian will be required to sign the Affidavit/Release on his/her behalf. Prizes or prize notifications which are undeliverable or unclaimed will be forfeited and may be awarded to alternate winners. By returning the completed Affidavit/Release, winner attests the authenticity of his/her winning entry. By accepting and/or using prizes, the winners agree and consent to the use of their names, voices, statements, photographs, likenesses, and other personal information by Sponsors and their designees in this and similar promotions for advertising and publicity purposes worldwide and in perpetuity in any and all forms of media now known or hereafter devised, including without limitation online, without compensation, permission or notification, unless prohibited by law. No substitution, transfer or cash redemption or substitution of prize is permitted (except by Hilton and National due to prize unavailability, in which event a prize of equal or greater value will be awarded). All applicable federal, state, local or other political division or subdivision laws and regulations apply.
Release: By participating in this Sweepstakes, all participants acknowledge and agree that Hilton, National and their respective parents, subsidiaries and affiliates, advertising and promotion agencies, licensees, those involved in the development, production, implementation, and distribution of this Sweepstakes, and/or any other persons or entities associated with this Sweepstakes, including, but not limited to persons affiliated with Sponsors, and the respective officers, directors, shareholders, employees and agents of the forgoing entities (collectively, the “Released Parties”) are released, discharged and held harmless from and are not responsible or liable for any liability with respect to all aspects of this Sweepstakes (including without limitation, any illness, losses, litigation, personal injury, death, property damage, and claims based on publicity rights, defamation, or invasion of privacy, reasonable attorney’s fees and court costs) that may occur from participation in this Sweepstakes and the acceptance, possession, use or misuse of any prize (including any travel related thereto). Sponsors are not responsible for any typographical or other error in the printing of the offer, administration of the Sweepstakes or in the announcement of the prizes.
Governing Law: In the event that any dispute arises regarding the meaning or interpretation of these Official Rules, the California Courts (state and federal) shall have sole jurisdiction to any controversies regarding this Sweepstakes and participants agree that the dispute shall be resolved by applying the laws of the State of California, and that it shall be resolved within and by the courts of that state individually and without resort to class action.
Offical Rules and Winners’ List: These Official Rules and the winners’ names (available after February 9, 2009) will be posted at 5millionreasons.com for a period of thirty (30) days.
